  1. About these Terms

These Terms set out how you may use our website and how we handle enquiries, quotes and project engagements that originate through the site. By visiting or using our website, submitting an enquiry, requesting a quote or engaging our services, you agree to these Terms and to our Privacy Policy.

We may update these Terms at any time by posting a revised version on our website. The updated Terms apply from the time they are published.

  1. Website Terms of Use

2.1 General information only

Content on our website is provided for general information. It is not technical, legal, financial or design advice. You should obtain advice specific to your project before acting.

2.2 Accuracy and availability

We try to keep content accurate and up to date, but errors and omissions can occur. We may change or remove content, features or pages without notice. We do not guarantee uninterrupted access to the site.

2.3 Intellectual property

Unless stated otherwise, all text, graphics, logos, photos, videos and other materials on the site are owned by us or licensed to us. You may view the site for your own use. You must not copy, reproduce, adapt, publish, sell, exploit or distribute site content without our prior written consent.

2.4 Permitted use

You must use the site lawfully and reasonably. You must not:

  • interfere with or disrupt the site or the servers that host it
  • introduce viruses, malware or other harmful code
  • scrape, mine, index, mirror or frame the site
  • use the site to harass, defame, abuse, threaten or infringe the rights of others
  • attempt to gain unauthorised access to any part of the site or our systems

2.5 Third party links

Our site may link to third party websites or services. We do not control and are not responsible for their content, security or privacy practices. Your use of third party sites is at your own risk.

2.6 User content

If you upload or submit any materials to us through the site, you:

  • warrant you have the right to provide them and that they are accurate and lawful
  • grant us a non-exclusive, royalty-free licence to use them to respond to your enquiry, prepare quotes and deliver services
  • must not upload anything that is unlawful, defamatory, obscene, misleading or that infringes third party rights

2.7 Security

We take reasonable steps to protect the site, but the internet is not risk free. We cannot guarantee the site will be free from bugs, viruses or vulnerabilities. You are responsible for your own antivirus and security.

2.8 Privacy and cookies

Our handling of personal information is explained in our Privacy Policy. Our site may use cookies and analytics to improve performance. By using the site you consent to that use.

  1. Enquiries, Quotes and Engagement

3.1 Enquiries

You can request a quote or site visit by phone, email or the contact form. Please provide accurate details including the site address, scope, access constraints, timeframes and any drawings or specifications.

3.2 Quotes and pricing

  • Quotes are based on the information available at the time and are valid for the period stated in the quote.
  • Unless stated otherwise, prices exclude GST and any statutory fees or charges.
  • A formal quote, scope of works and our project terms will govern each engagement. If there is any inconsistency, the signed contract or purchase order takes precedence over these website Terms.

3.3 Scope, variations and latent conditions

  • The quoted scope covers only the items described. Anything not expressly included is excluded.
  • Variations requested by you or required due to site conditions, design changes or compliance requirements will be priced and approved before we proceed.
  • Latent conditions include hidden or unknown issues such as structural defects, services not shown on drawings, water ingress, asbestos or other hazardous materials. If latent conditions are discovered, we will notify you and provide a variation.

3.4 Site access and responsibilities

You must ensure safe and reasonable access to the site, including:

  • clear work areas, secure storage and amenities where agreed
  • available power, water and services where required
  • timely access for our staff, subcontractors, suppliers and inspectors

If access is delayed or restricted, additional costs or time may apply.

3.5 Safety and compliance

We operate under our Work Health and Safety systems and comply with applicable laws and standards. You agree to:

  • inform us of known hazards and site rules
  • facilitate required inductions and permits
  • not instruct any work that would breach WHS or building laws

Where work involves passive fire systems, fire-rated and acoustic systems, external cladding, engineered partitions or similar regulated elements, certification will be provided as specified in the contract.

3.6 Permits and approvals

Unless the contract states otherwise, you are responsible for planning approvals, building approvals, landlord approvals and any consents not expressly included in our scope.

3.7 Subcontractors and suppliers

We may engage qualified subcontractors and suppliers to perform parts of the works. We remain responsible for managing them.

3.8 Working hours and neighbours

Our standard working hours are Monday to Friday, 7.00 am to 4.00 pm, unless agreed otherwise or required by site rules. We will take reasonable steps to minimise noise and disruption.

3.9 Delays and force majeure

We are not liable for delays caused by events beyond our reasonable control, including severe weather, supply shortages, industrial action, illness, pandemic restrictions, utility outages, third party failures or regulatory actions. Time will be extended for the period of the delay. Additional costs caused by such events may be treated as variations.

3.10 Invoicing and payment

Payment terms will be specified in the quote or contract. Unless stated otherwise:

  • progress claims are issued at agreed milestones or monthly in arrears
  • payment is due within the period stated on the invoice
  • late payments may attract reasonable administration fees and interest at a fair market rate
  • we may suspend works for non-payment after giving notice

Title in materials passes to you on full payment. Risk in materials passes on delivery to site.

3.11 Warranties and defects

We warrant that our workmanship will be carried out with due care and skill and in accordance with applicable laws. Manufacturer warranties apply to materials and products. A defects liability period will be stated in the contract. This warranty does not cover fair wear and tear, misuse, lack of maintenance, alterations by others or damage outside our control.

3.12 Cancellations

If you cancel after acceptance of a quote, you agree to pay for work completed to date, materials ordered or delivered, restocking fees where applicable and reasonable demobilisation costs.

  1. Careers and Job Applications

If you apply for a role with us you confirm that the information you provide is accurate and that you have the right to work in Australia. We may conduct reference checks, licence checks and other pre-employment screening. We are an equal opportunity employer and consider applicants based on merit, qualifications and cultural fit.

  1. Liability and Disclaimers

5.1 Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantees, rights or remedies you may have under the Australian Consumer Law that cannot be excluded.

5.2 Limitation of liability

To the extent permitted by law, and except for liability that cannot be limited or excluded:

  • our total aggregate liability for all claims arising out of your use of the site is limited to one hundred dollars
  • our liability for services delivered under a contract is limited as set out in that contract
  • we are not liable for any indirect, special or consequential loss, loss of profit, revenue, opportunity, production or business interruption

5.3 Indemnity

You indemnify us against losses, costs and liabilities we suffer as a result of your breach of these Terms or misuse of the site, except to the extent caused by our negligence or wilful misconduct.

  1. Complaints and Dispute Resolution

If you have a concern, please contact us first so we can try to resolve it quickly. If a dispute arises under a project contract, the dispute resolution process in that contract will apply.

  1. General

7.1 Governing law

These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.

7.2 Severability

If any part of these Terms is invalid or unenforceable, the remainder continues in force.

7.3 Assignment

You must not assign or transfer your rights under these Terms without our written consent. We may assign our rights where reasonably necessary for our business, such as a restructure or sale.

7.4 Entire agreement

For website use, these Terms and our Privacy Policy are the entire agreement between you and us. For any project engagement, the signed contract or purchase order and its documents form the entire agreement for that engagement.

7.5 Electronic communications

You consent to us contacting you electronically, including by email and phone, and to receiving documents in electronic form.

  • We, us, our means Qline Industries Pty Ltd.
  • You means a site visitor, enquirer, client, applicant or other user of our site.
  • Site means our website and any pages or services we operate under the Qline Industries brand.
  • Quote means a written price and scope offer we issue for proposed works.
  • Contract means the agreement between you and us for supply of services or works.
  • Latent conditions means physical conditions at the site that could not reasonably be foreseen before works started.
